The HOT Tap News

Welcome to the summer edition of The HOT Tap News. 

It remains tough times with the economy still struggling and the threat of swine Flu and the potential impact on companies who are as ‘lean’ as they can be.  However, there are some bits of good news and some fun still being had.

In this edition we look at making preparations for Swine Flu now that it seems to be moving through the population unchecked. 

You will note that John’s Health & Safety article is brief this time, he has just completed a Lands End to John O’Groats cycle ride in aid of Help for Heros’ so has been a little busy recently.  If you would like to find out more about his adventures then visit http://jrbbikeride.blogspot.com/.  Nice to see that some people can find some time to have some fun!?? 

Other information that readers should be aware of is that the National Minimum Wage is due to increase by 1.2% in October this year to £5.80, the development rate will increase to £4.83 and the rate for 16 & 17 year olds increasing to £3.57 per hour. 

We have finally got the decision regarding the accrual of holiday for long term sick employees which is that holiday does continue to accrue during long term absence and should be paid at the end of the employment.  At the present time there is a clash of legal views as it is not allowed to carry holiday over under the Working Time Directive and yet this is what the latest case law has indicated in this situation.  We await further developments but the clear point is that holiday is still accrued and will need to be dealt with.

Swine Flu - the pandemic.

We have all got our own views about whether Swine Flu will turn into another Bird Flu story i.e. one that fades from the news without having turned into the pandemic that the media warned us about.  However, things have progressed further with Swine Flu, while it is clear that it is not going to kill the majority of those that catch it it is known that for certain groups of the population Swine Flu represents a real risk.  With the Government talking about extending the period for which an employee can ‘self-certificate’ when ill from 7 days to 14 and country wide vaccinations employers should be aware of the impacts Swine Flu could have on their operation and make some contingency plans. 

As an employer you will want to be able to deal with the situation of significant absences.  You also need to make it clear to employees that you have a policy in place which details how specific situations are dealt with (while preventing abuse of the systems that you have in place) and a method of communicating with your employees.

HSE cutting paperwork - John Bartlett

Get rid of the excessive paperwork. Keep it simple. This is now the viewpoint of the HSE and its well worth a look at their newly re branded website. 

They are even going to be allowing you to download all their documents, ACOP’s (Approved Code of Practice) etc free in September 2009. Why on earth should I be telling you this? I believe there should be no secrets in the world of health and safety and the one thing I find depressing is the continual re inventing of the wheel with some of this. For some time the HSE have been very vocal about ‘sensible risk management’ and have tried hard to dispel the myths that are generated about how difficult assessing risk is. On closer inspection the majority of those concerns are just that, myths, or issues that are being generated by the insurance companies not health and safety professionals.
